edelkrone Software Store Listing Agreement

Version 2.0 (draft). Effective on the date it is published.

This agreement is between you and edelkrone USA Inc. ("edelkrone", "we"). It covers listing your Applications in the edelkrone Software Store (the "Store"). It works together with the edelkrone SDK License Agreement (the "SDK License"); words defined there have the same meaning here. By submitting an Application to the Store, you agree to this agreement.

The short version

The Store is where edelkrone customers discover software for their edelkrone Devices.
edelkrone does not sell, host or deliver Applications. Each listing links to the place where you offer your Application: your website, the App Store, Google Play or any other channel.
Listing is free. edelkrone takes no commission.
Listings are open to Applications that work with edelkrone Devices and follow the SDK License.
You are responsible for your Application, its sale, delivery and support.

1. How the Store works

The Store presents Applications to edelkrone customers. Each listing shows your Application's name, description, supported devices, screenshots or videos, and a link to the place where you offer it (for example "See on the App Store" or "Visit website"). Customers obtain, buy and download your Application there, under the terms of that place and your own terms. edelkrone is not a party to those transactions and does not receive any payment from them.

2. Eligibility

To submit or keep a listing you must have an edelkrone.com account, and your Application must be built and distributed in line with the SDK License.

3. Submission and review

edelkrone reviews every submission before it is listed and may accept or reject it at its discretion. Your Application and its listing must:

work with the edelkrone Devices it claims to support, as described;
follow the safety requirements of the SDK License, including letting the user stop motion at any time;
contain no malware, hidden functions or code that collects data without the user's knowledge;
describe the Application honestly, including what it does, which devices it supports and what it costs;
link to a working page where the Application is offered, and include a way for users to reach you for support;
respect the rights of others, including copyrights and trademarks.

You must keep your listing accurate. When you release an update that changes what the Application does, which devices it supports or what it costs, update your listing.

4. Your responsibilities

You are responsible for your Application: hosting it, selling or distributing it, collecting any payment, handling refunds and taxes, providing support and keeping the promises you make in your listing. edelkrone does not provide support for listed Applications and may forward user questions to you.

5. When your SDK license ends

If your SDK license is terminated for a breach, your listings are removed.

6. Removing listings

You may remove your own listings at any time. edelkrone may remove a listing at any time, for example when an Application or its link stops working, the listing breaks the rules in Section 3, the Application receives repeated safety or quality complaints, or the developer's SDK license has been terminated. Where possible, edelkrone will tell you the reason.

7. Rights you give edelkrone

You keep all rights you hold in your Application. You give edelkrone the non-exclusive right, for as long as the Application is listed, to use your Application's name, icon, screenshots, videos and description to present and promote it in the Store and in edelkrone's marketing.

8. Changes and termination

edelkrone may change this agreement or the Store by publishing an updated version. Either party may end this agreement at any time; your listings are then removed.

9. Liability

The Store is provided "as is" and free of charge. To the extent the law allows, edelkrone is not liable for indirect, incidental or consequential damages or lost profits arising from the Store or from the removal of a listing. You are responsible for claims that arise from your Application.

10. General

This agreement is governed by the laws of the State of Florida, USA. If a provision of this agreement is found unenforceable, the rest stays in effect. Together with the SDK License, this agreement is the complete agreement between you and edelkrone about the Store.
